Cynvend Card terms and Conditions

These Terms and Conditions ("Agreement") govern your use of the CynVend vending service ("Service") provided by Cynteq Technologies Limited. ("CynVend," "we," "us," or "our"). By using the Service, you agree to comply with and be bound by the terms and conditions outlined below. Please read them carefully.

1.Acceptance of Terms

1.1. By accessing or using the Service, you agree to be bound by this Agreement, including any future modifications. If you do not agree to these terms, you may not use the Service.

1.Data Protection

2.1. 2.1. CynVend is committed to protecting the privacy and confidentiality of your personal data. We will only collect, use, and retain your personal data in accordance with our Privacy Policy.

2.2. Personal data collected by CynVend is retained on our servers for the sole purpose of providing the Service to you. We may collect and process personal data, including but not limited to, your name, contact information, and transaction details.

2.3. We will not share your personal data with third parties unless required by law or with your explicit consent.

1.Retention of Personal Data

3.1. Once you leave the CynVend platform, we will retain your personal data for a period of two (2) months.

3.2. During this retention period, you have the opportunity to raise disputes or litigation accusations related to your use of the Service. This allows us to resolve any issues that may arise during or after your use of the Service.

Disputes and Litigation

4.1. If you have a dispute or claim against CynVend, you must notify us within the two (2) month retention period mentioned above. Failure to do so may result in the forfeiture of your rights to pursue any dispute or litigation.

4.2. All disputes and claims will be resolved in accordance with the laws of the jurisdiction where CynVend is based.

Intellectual Property

5.1. All intellectual property rights, including trademarks, copyrights, and patents, related to the Service are owned by CynVend. You may not use, reproduce, modify, or distribute any content from the Service without our prior written consent.

Limitation of Liability

6.1. CynVend shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use of the Service or any actions or omissions related to this Agreement.

Amendments to the Agreement

7.1. CynVend reserves the right to modify or update this Agreement at any time without prior notice. We will notify you of any significant changes to this Agreement through the email address associated with your account.

7.2. Your continued use of the Service after the modifications or updates to this Agreement will constitute your acceptance of the revised terms.

Termination

8.1. CynVend may, at its discretion, suspend or terminate your access to the Service at any time, without notice or liability, for any reason.

8.2. Upon termination, all rights granted to you under this Agreement will immediately cease.

Severability

9.1. If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of the Agreement shall remain in full force and effect.

Lost Card Replacement

10.1. In the event that you lose your CynVend vending service card, you are responsible for requesting a replacement card.

10.2. A lost card replacement fee of USD 10 or the equivalent value in Kenyan shillings will be charged for the issuance of a new card.

10.3. The lost card replacement fee covers administrative costs associated with issuing a new card and ensuring the security of your account.

10.4. The replacement card will have the same functionality and value as the original card.

10.5. The lost card replacement fee will be deducted from the remaining balance on your account, or you will be required to pay the fee separately before the replacement card is issued.

Please note that this lost card replacement policy is put in place to ensure the security and integrity of your CynVend vending service account.
